Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the marketer.net website and the marketer.net Facebook comment moderation service (collectively, the "Service") operated by marketer.net ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Service Description

marketer.net provides an AI-powered Facebook comment moderation and response service that helps businesses manage comments on their Facebook pages. The Service processes user data from Facebook comments, including but not limited to comment content, user identifiers, timestamps, and other metadata provided by Facebook's API.

2. Account Terms

To use our Service, you must:

  • Create an account with us
  • Provide accurate, complete, and up-to-date information
  • Be at least 18 years old
  • Be responsible for maintaining the security of your account and password
  • Promptly notify marketer.net if you discover or suspect any security breaches related to the Service

3. Facebook Page Connection

To use our Service, you will need to connect your Facebook business page(s) by authorizing our application through Facebook's API. You represent and warrant that you have all necessary rights and permissions to connect these pages to our Service and to allow us to access, process, and moderate comments on your behalf.

4. Data Processing

By using our Service, you acknowledge that we will process user data from Facebook comments. This includes:

  • Comment content
  • User identifiers
  • User profile information available through Facebook's API
  • Timestamps and other metadata

We process this data to provide our Service, including but not limited to:

  • Automatic moderation of comments
  • Generation of AI-powered responses
  • Analysis of engagement metrics
  • Notification of important comments or issues

5. Data Protection and GDPR Compliance

We are committed to protecting your data and the data of Facebook users whose comments we process. We comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

6. Billing and Payments

You are responsible for paying all taxes associated with your use of the Service. If you believe your bill is incorrect, you must contact us within 60 days of the billing date to be eligible to receive an adjustment or credit.

7. Free Trial

We may, at our sole discretion, offer a free trial for new users. The duration of the free trial period and other details will be specified during the sign-up process.

After the trial period, your account will automatically be charged according to the plan you selected unless you cancel your subscription before the end of the trial period.

8. Cancellation and Termination

You may cancel your subscription at any time through your account settings or by contacting our customer support. Upon cancellation, your subscription will remain active until the end of the current billing period.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of marketer.net and its licensors. The Service is protected by copyright, trademark, and other laws of both the European Union and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of marketer.net.

10. Content Generated by AI

As part of our Service, we use AI to generate content for responses to Facebook comments. You acknowledge that:

  • AI-generated content may not always be appropriate for all situations
  • You are ultimately responsible for reviewing and approving any AI-generated content before it is posted, if you use our automatic posting features
  • We do not guarantee that AI-generated content will be free from errors, biases, or inappropriate content

11. Limitation of Liability

In no event shall marketer.net, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the European Union and Italy, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
